Unless otherwise stated:
* The term "Client” refers to the parent or carer that are using Babysitters R Us to book a babysitter.
* The term "Sitter" refers to the babysitter referred by Babysitters R Us to undertake child caring duties as
required and directed by the client.
WHEREAS the parties agree as follows:
1. AGENCY BABYSITTING SERVICE IS NOT AN INTRODUCTION SERVICE.
(a) The Client acknowledges that they understand and agree not to approach any Babysitters R Us registered Sitter for private work. This means the Client is not permitted to engage the services of any Babysitters R Us Sitter directly and without making a formal booking through the agency. At no time is this practice permitted by the Client or Sitter - and any approach by a Client to a Sitter will result in the Client being refused any further services by Babysitters R Us.
(b) The Client is also not permitted to pass along the details of any Sitter introduced to the Client by Babysitters R Us to a 3rd party, such as a friend or family member for the intention of arranging private babysitting sessions.
(c) Should a Sitter be found in breach of 1(a) they will be de-registered from the Agency.
2. PAYMENT OF AGENCY BOOKING FEES
(a) The Client is required to pay the agency booking fee relevant to their booking, directly to Babysitters R Us for each booking session made, except where alternative arrangements have been made and advised in writing by Babysitters R Us.
(b) The Client is required to pay the relevant agency booking fee by credit card and/or debit MasterCard.
(c) Payment of the agency booking fee must be received by Babysitters R Us prior to the booking start time, or the agency may refuse to provide a Sitter for the Client.
(d) Failure to make payment of the agency booking fee where a Sitter has been provided to the Client, or cancellation of the agency booking fee payment after the booking session will result in Babysitters R Us referring all outstanding amounts to a collection agency, and the Client will become liable for further collection charges.
(e) All agency booking fees are non-refundable, and payable once the agency has arranged a suitable babysitter for the Client.
3. PAYMENT FOR THE BABYSITTER
(a) Payment for any relevant Sitter's fees is to be made by the Client directly to the Sitter at the conclusion of each booking.
(b) Payment can only be made in cash. Credit card payment MAY be arranged with the agency, but this MUST be arranged prior to the booking date and the Sitter is not obligated to accept payment via this method.
(c) The Client is required to pay the Sitter for all hours the Sitter is on-site for the booking, even if this extends past the original booking end time.
(d) Sitters are required to be paid for a minimum of 3 hours, even where the booking time requested or transpired (during the course of a booking) is less than 3 hours.
(e) The Client is required to pay the Sitter a prorated rate (based on the applicable hourly rate), for any period which is less than the agreed to time as it appears on the booking confirmation advice (unless it is a period that is less than the minimum 3 hours in which case section 4(d) applies).
(f) If the Sitter is not paid in cash at the conclusion of their booking the Client agrees for all outstanding babysitter fees to be charged to the credit card the Client provided at the time of their booking. The Client also agrees that in this situation an administration fee will charged. The administration fee is $5.00 for amounts owed up to $200.00 and $15.00 for amounts owed over $200.00.
(g) Failure to make payment of the Sitter's fees via cash, or credit card will result in Babysitters R Us referring all outstanding amounts to a collection agency, and the Client will become liable for further collection charges and agency administration fees.
(h) If the Sitter is required to attend a booking at a hotel or accommodation venue then it is the Client's responsibility to cover the Sitter's parking costs. The Sitter must park on-site or in a car park, or metered parking site located reasonably close to the accommodation venue so as to allow for safe travel to and from the Sitter's car. If there is free parking located at the venue, or on the street outside the accommodation venue then it is reasonably expected that the Sitter will use the free parking.
(i) Where the Sitter is required to transport children in their care the Client agrees to pay a travel fee to the Sitter. The minimum travel fee payable is $5 per journey, up to 8 km. Any km travelled over the first 8 km are payable at the rate of 65 cents per km.
(j) Where a Sitter is required to travel to a client, an additional travel fee of $10 will apply for travel under 30 km distance and $20 for travel greater than 30 km in distance.
4. DURING A BABYSITTER BOOKING
(a) If The Client requires the Sitter to take children on an outing the Sitter will not remove a child from the residence and/or accommodation unless there is express written consent by the Client authorising the Sitter to do so, and allowing the child/ren to participate in activities away from the principle booking location.
(b) If the Client will not be present at the end of the booking to do a handover with the Sitter, then the Client is required to provide full details of who the Sitter is authorised to leave the child/ren with including their full name and contact phone number. These details are required to be provided in writing via the Family Information Checklist or via the original booking form submitted to Babysitters R Us.
(c) If a child has any special needs or requirements (e.g. medical conditions, toilet training requirements, allergies etc.) the Client must advise the Sitter immediately.
5. BOOKING CANCELLATIONS
(a) A cancellation fee equivalent to the minimum 3 hour booking charge will apply if the session is cancelled less than 24 hours prior to the sitting session. The agency booking fee is non-refundable.
(b) A cancellation fee of $100 will apply if the session that is cancelled is for New Year's Eve (NYE) with less than 72 hours prior to the sitting session. The agency booking fee is non-refundable.
(c) If a cancellation is made with more than 24 hours notice or 72 hours for NYE bookings, the client is not required to pay any costs associated with babysitter’s rate for the session, but the agency booking fee is non-refundable.
(d) The Client agrees that payment for any booking cancellation fees will be charged to the credit card they provided to Babysitters R Us at the time of making their booking. If the credit card payment is declined the agency will notify the Client immediately and request additional card details be provided to the agency within 24 hours.
(e) Where payment of the booking cancellation fee is outstanding 7 days after the original booking date the Client agrees that all outstanding babysitter cancellation fees will be referred by Babysitters R Us to a collection agency, and the Client will become liable for further collection charges and agency administration fees.
6. COMBINED FAMILY BOOKINGS
(a) An additional $5.00 agency booking fee, plus an extra $2.00 per hour is payable by the client/s when combined family bookings are made for up to 3 children. Extra children will be charged at the rate of $3.00 per child, per hour.
(b) If a combined family booking is not prearranged with Babysitters R Us, then the Client will be charged all additional rates, plus an extra $25 administration fee. This will be charged to the credit card the Client provided at the time of making their booking. Failure to make payment of these additional fees will result in Babysitters R Us referring all outstanding amounts to a collection agency, and the Client will become liable for further collection charges.
7. LIABILITY & WARRANTIES
(a) Babysitters R Us accepts no responsibility for any damage, injury expense or loss directly caused by any Sitter referred to the client by Babysitters R Us.
(b) Registered Sitters have varying degrees of first aid knowledge & training. It is the responsibility of the client to discuss any first aid training requirements with the Sitter at the time of the booking as Babysitters R US take no responsibility for the first aid response administered by a Sitter in the case of a medical emergency.
(c) Babysitters R Us conducts a thorough interview & screening process, however Babysitters R Us does not give any warranty concerning the character of the Sitters introduced. It is the responsibility of the Client to accept and approve the suitability of Sitters. If the Client has any concerns regarding the suitability of the Sitter they should contact Babysitters R Us immediately.
8. INFERRED EXTENTION OF TERMS & CONDITIONS
If there are further appointments or bookings organised by the parties after the signing of this agreement the parties acknowledge that these terms and conditions will apply to all such further appointments and bookings until such time that either party requests a new agreement - such as when Terms & Conditions are updated.
